Chief Judge Kaye’s possible replacements named

An Albany attorney and former professor at Albany Law School is one of seven nominees to become the state’s top judge.

George Carpinello, partner at the Albany office of Boies Schiller & Flexner LLP, was suggested by the state Commission on Judicial Nominations. The commission issued a report on Monday naming seven possible replacements for Chief Judge Judith Kaye, who must retire because she has reached the state’s mandatory retirement age of 70.

Kaye retires on Dec. 31. Gov. David Paterson is expected to choose a nominee within the first two weeks of January, and that person must be confirmed by the state Senate.

At a press conference on Monday, Paterson said he had not taken a look at the list.

Kaye leads the state’s highest court, the Court of Appeals, which is located in downtown Albany. She is the first woman ever on the seven-member court, and she’s also the state’s first female chief judge.

This is the third straight year that the commission has nominated Carpinello to a position in the court.

Carpinello, in his late 50s, earned degrees at Princeton University and Yale Law School before coming to Albany in 1979. He was a partner of Albany law firm McNamee Lochner Titus & Williams P.C. before joining his current firm, which has 12 offices in six states and the District of Columbia.

Carpinello was a professor at Albany Law School from 1984 to 1992, and also served as the director of its Government Law Center for a few years.

A phone call to Carpinello’s office was not immediately returned. Carpinello’s brother, Anthony Carpinello, has been a state Supreme Court justice for 14 years, until he was unseated in last month’s elections.

The state judicial commission also suggested six other options as Kaye’s replacement. They are:

• Evan Davis: partner at Cleary Gottlieb Steen & Hamilton LLP; former candidate for state Attorney General; former counsel to Gov. Mario Cuomo.

• Steven Fisher: a justice in the state Supreme Court’s appellate division in Brooklyn. The commission has nominated him for a Court of Appeals position five times.

• Theodore Jones Jr.: a justice on the Court of Appeals, appointed to the position in early 2007.

• Jonathan Lippman: top justice in the state Supreme Court’s appellate division in New York City.

• Eugene Pigott Jr.: a justice on the Court of Appeals, appointed in mid-2006.

• Peter Zimroth: partner at Arnold & Porter LLP; former chief legal counsel for New York City government.
